Actually, I watched the video out of curiosity when it was mentioned. It would be bad optics for Mark to go after them legally, as it could very much look like he would be doing so simply because the dating sim itself is rather queer-coded, since there are lots of other creative work that references him that he's had no problem with in the past. Mark is entitled to feel however he feels about it, but there's not much he can do about it. You could still argue it's a bit disrespectful to put someone in a dating sim without their knowledge, but I personally the think it's vague enough for it to be kinda silly for someone to have a problem with it.

If the character was named Markiplier, AND it was an unfavorable misrepresentation of him, then it would be a different story. You don't need to ask someone's permission to base a character on them.
